As per the Union Budget 2023, the Government of India passed a Finance Bill introducing new tax laws for online gaming for the financial year 2023-24. According to the bill, it is mandatory for online gaming platforms to deduct Tax at Source (TDS) whenever a player makes a withdrawal and also at the end of the financial year. TDS will be levied at 30% of all the ‘Net Winnings’ of the player.
TDS stands for Tax Deducted at Source. Whenever a player requests a withdrawal, a 30% tax is deducted only from the Net Winnings of the player.
As per income tax regulations, individuals or organizations obligated to make payments of a specified nature to another party are required to deduct tax at source and remit it to the Central Government. A TDS certificate is then issued by the entity that deducted the tax.
Net Winnings refer to the difference between the total amount of money withdrawn by a player and the deposits they have made.
Formula: Net Winnings = Total Withdrawals – Total Deposits
A player deposits Rs. 10,000 in their Rummy wallet on 10 May 2023. Their opening balance on 1 April 2023 was Rs. 5,000. They play and win Rs. 30,000, which gets added to their withdrawal balance. If they withdraw Rs. 25,000 on 25 May 2023:
Net Winnings = 25,000 – (10,000 + 5,000) = 10,000
30% TDS on Rs. 10,000 = Rs. 3,000. Hence, the player receives Rs. 22,000.
For non-cash prizes (cars, bikes, gadgets, etc.) won through Rummy Game, a 30% TDS must be paid before receiving the prize. Rummy Game will remit the TDS to the government and issue a TDS certificate.
Effective from 1st October 2023, the Government of India amended the National GST Laws, imposing a 28% GST on every deposit made on all Online Money Gaming Platforms.
